TERMS & CONDITIONS
By ordering on this website, or via email or telephone, you agree to the following terms and conditions. These terms & conditions apply for all commissions of original artwork by Andrew Webb trading as Andy Webb Art (“the artist”), unless otherwise agreed by the artist in writing.
It is the responsibility of the client to provide photos of the true likeness/character of the subject to ensure optimum results. Any commission must be accompanied by sufficient information to enable the artist to proceed.
All commissions will be accepted at the discretion of the artist.
Any physical photos or supporting material are left with the artist at the client’s risk. No responsibility will be taken for loss or consequential loss of clients’ property left with the artist.
No commission will proceed without payment of a minimum deposit of 15% of the total price agreed for the work. The minimum deposit is non-refundable.
The artist will provide visual updates of the work prior to and upon completion. Balance of payment will be due prior to dispatch of the finished piece, either by instalments or in full upon completion. Finished work will not be sent out until the balance has been received by Andy Webb Art. If payment is made by cheque, goods will be sent out after funds have cleared at the bank.
The client must check goods immediately on delivery and inform the artist of any damage suffered in transit. For items sent by post or courier, the artist bears no responsibility for failed or late deliveries. If an item is returned for any reason, postage will be re-charged for any subsequent delivery attempts. Any items that do not arrive on the date specified should be reported within 24 hours of non-delivery. Any reasonable dis-satisfaction with the finished work must be reported within 7 days of receipt of goods. Item(s) must be returned at the client’s expense before a refund can be considered. Minimum deposits are non-refundable and only the balance payment will be considered for refund.
Copyright of all work remains in the name of Andrew Webb, unless otherwise mutually agreed in writing at the time of ordering. It is explicitly forbidden to reproduce the images or original work of the artist in any medium unless clearly agreed beforehand with a standard license contract available on request. This license can be revoked at any time due to breach of contract at the discretion of the artist.
As copyright holder Andrew Webb reserves the right to use any image or edited image for any publicity online via website and social media, exhibition material or other promotional events. The image or edited version may be used on products produced by Andy Webb Art, or by other companies manufacturing under license from Andy Webb Art. Any requests for portraits not to be used in this way must be expressed in writing within 14 days of completion of your order.
Any authorised reproductions must contain credit to Andy Webb or Andy Webb Art. Where digital images are involved the client agrees that the digital images cannot be modified without prior consent and must contain credit to Andy Webb or Andy Webb Art.
Any order placed where there is no follow-up or contact from the customer of any kind will after 12 months be considered void. Any money paid will become property of Andy Webb Art.
All goods and artwork remain property of Andy Webb Art until the contract price in full is received. Orders not collected within 30 days of completion are liable to storage charges.
CANCELLATION
If the client wishes to cancel the contract for a commission, then notice must be given in writing.
All minimum deposit payments are non-refundable. Any amount paid in advance in addition to the minimum deposit will be refunded at the artist’s discretion, dependent on how much work has already been completed.
